Aunt Emma, and the reverend go to visit Jefferson and they find that Grant’s previous account of Jefferson’s recovery was lie; Jefferson still eats and behaves like a â€Å"hog†. Aunt Emma and the reverend confront Grant regarding his faulty account of Jefferson’s recovery. Once again, Grant visits Jefferson and tries to convince him that he is not a hog and he is a man. After a couple more visits from the ladies and Grant, the chapter ends off with the whole town watching a Christmas play on the birth of Jesus. After the play, Grant is tired of watching the same play and seeing the same people dressed in the same kinds of clothing year after year. The hermeneutic view means the dominant interpretation to a text. In â€Å"A Lesson Before Dying,† they end off the chapter with a Christmas play about the birth of Jesus. This is significant because Christmas to Christian’s is a symbol of birth. This could mean that there might be new hope for Jefferson. This is because Jefferson is currently on death row. Christmas does not symbolize death, but symbolizes birth. This could mean that Jefferson could get a new chance in life or at least will not be executed in the near future. Another important point is that everyone knew that this play is dedicated to Jefferson/. This could mean that the whole community is praying for Jefferson. The reverend started to pray and asked God to watch over everyone including the ones in jail who were innocent or guilty. At the end of this, Grant says, â€Å"Vivian said things were changing. But where were they changing?† This is an important quote because Vivian might be implying tha t racism is beginning to stop, but Grant cannot see these changes. He only sees racism as a part of life. According to the political view, there is a hierarchical structure underneath the construction of race.When Grant has a talk with his teacher, his teacher said, â€Å"I am superior to you. I am superior to any man blacker than me.† His teacher is possibly implying that lighter skin color is racially superior in society. Grant’s teacher is of a lighter skin color (being Creole) therefore, his teacher is also reinforcing his own racial superiority over Grant. Another point is when he calls Grant a nigger. â€Å"He’ll make you the nigger you were born to be.† I think that the usage of â€Å"he’ll† is referring to â€Å"the white society† and how whites have the power to produce labels such as â€Å"nigger†. This negative label has the power of determining and limiting the fate of a black person because; everyone will begin to treat blacks differently after associating them with being â€Å"niggers†. If society believes in th e negative label of â€Å"nigger† it will decrease a black person’s opportunity to receive education, employment, etc., therefore perpetuating their lack of status within society. Grant’s teacher also said that to survive in a white man’s world, you basically have to adapt in their culture and do everything a white man does. Grant’s response is â€Å"My only choice is to run, then?† This means that the only thing to do is to runaway from society’s label. However, Grant’s teacher predicts that Grant â€Å"won’t run†, he says this because, he realizes that it is easier to assimilate into the â€Å"white† culture rather trying to rebel.

Disparate Treatment/Disparate Impact Employment discrimination is discrimination in hiring, promotion, job assignment, termination, and compensation. Like most discrimination, employment discrimination may take place intentionally or unintentionally. There are many types of illegal discrimination; however, I will discuss the two main types, disparate treatment and disparate impact, and the affect they have on individuals and groups in the following paragraphs. Background The U.S. Equal Employment Opportunity Commission (EEOC) enforces laws enacted to prevent job discrimination. They are also involved in overseeing and policy making as it is related to job discrimination. Anyone who feels that their employer has discriminated against them in any way as defined by the EEOC; they have the right to file a complaint. One of the largest legislation the EEOC enforces is Title VII of the Civil Rights Act of 1964 (www.eeoc.gov) Title VII was established to ensure fair employment practices would be followed and free from discrimination. Two specific acts prohibited by Title VII are disparate treatment and disparate impact. Disparate Treatment Runkel defines disparate treatment as, when an individual of a protected group is shown to have been treated differently than other individuals similarly positioned. (Runkel, 2005) The issue is whether the employer?s actions were motivated by discriminatory intent. Discriminatory intent can either be shown by direct evidence, or through indirect evidence. An example of a disparate treatment case is McDonnell Douglas Corp. v. Green, 411 U.S. 792 (1973). McDonnell Douglas Corp was an aerospace company in St. Louis. Percy Green was a black mechanic and laboratory technician laid off by McDonnell Douglas in 1964 during a reduction in force at the company. Green a civil rights activist protested that his discharge was racially motivated. He and others used cars to block roads to McDonnell Douglas factories. After this incident, McDonnell Douglas advertised for vacant mechanic positions, for which Green was qualified. McDonnell Douglas rejected Green?s re-employment application on the grounds of his participation in blocking traffic and Green was not hired. Green filed a complaint with the Equal Employment Opportunity Commission (EEOC) charging violation of Title VII of the Civil Rights Act of 1964. The EEOC found reasonable cause to believe that McDonnell-Douglas Corp.?s rejection of Green?s re-employment application violated the Act, which forbids discrimination against applicants or employees for attempting to protest or correct allegedly discriminatory employment conditions. The court made no finding on Green?s allegation that the McDonnell-Douglas had also violated the section which prohibits discrimination in any employment decision. (Green, 1999) Disparate Impact According to the legal dictionary, disparate impact also known as adverse impact refers to situations where an employment policy or practice adversely affects a protected class of employees. (?Disparate Impact,? n.d.) An example of this is when an employer uses a selection criterion that, intentionally or not, screens out an unequal number of women and/or minorities. Under the doctrine, a violation of Title VII of the 1964 Civil Rights Act may be proven by showing that an employment practice or policy has an unreasonably adverse effect on members of the protected class as compared with non-members of the protected class. They have also established an extensive network of tax treaties which include the provision of exchange of information. This makes it important to ensure that management is based somewhere fiscally neutral. The following three principal elements make Ireland stand out as a tax haven  [3]  : Corporate Taxation in Ireland is set at 12.5% on profits for all trading companies (non-trading income is taxed at 25%). A 25% corporate tax rate relates to passive income whereas capital gains tax is 30%. Near-absence of transfer pricing rules (source of loopholes in international tax) lets multinationals artificially relocate their profits away from Ireland, usually via transfer pricing mechanisms, to lower-tax or zero-tax jurisdictions. As such, large portions of multinationals profits are sheltered from Irish tax. Membership in the European Union grants Ireland political stability and special access to European markets, membership has also kept it tax haven blacklists (e.g. Caymen Islands and Bermuda), and many countries that would apply withholding tax on interest paid to traditional tax havens do not apply them to Ireland because its classified as onshore. Relationships with International Bodies Overall, Irelands place within the European Union, weak rules on transfer pricing, and broad network of tax treaties make it particularly attractive for offshoring. Effective tax rates were estimated at 7.3% in Ireland compared with 37% in France and 26% in Canada  [4]  . It is a dependency of the Crown so is able to set many of its own laws except on issues of defense, foreign affairs and consular services. Isle of Man contributes financially to the UK for these services and protection. Economy The Isle of Man has a very impressive track record regarding its economic success. The Isle of Man has been a remarkable economic story in the past three decades and has benefited from 28 years of continuous economic growth as quoted from an Ernst and Young Report, Isle of Man: Economic Report dated May, 2012. The GDP of  £3.2 Billion ($4.9bn US) is very high for a population of only approximately 85,000 people  [6]  . The Isle of Man also enjoys full and free access of Industrial and Agricultural goods movement with the European Union under Protocol 3 of the Treaty of Succession. Income tax is often zero unless they are engaged in earning profits from Isle of Man land e.g. rental income or property development or from banking then the rate of tax is 10%. Residents of the Island pay up to 20% of their total income to a maximum of 120,000 in tax which has proven attractive for the very wealthy. Capital gains tax is zero  [7]  . Since many view the Isle of Man as a tax heaven there are certain risks with this location. GIBRALTAR Background Strategically significant, Gibraltar was relinquished to Great Britain by Spain in the 1713 Treaty of Utrecht. This led to the British garrison being declared a colony in 1830. In 1969, Gibraltar was granted autonomy by the UK which led Spain to close their border and sever all ties. Between 1997 and 2002, the UK and Spain held talks aimed at establishing a temporary joint sovereignty over Gibraltar. This move was however rejected by most Gibraltarians following a 2002 referendum. Tripartite talks have continued since 2004 with the hopes of resolving current disputes and developing cooperation agreements dealing with such things as taxation, communications, customs services, and other contentious issues. In 2009, a dispute over territorial waters gave rise to sporadic non-violent confrontations between Spanish and UK naval patrols. Recommendation To come to a recommendation we compared each jurisdiction using the eight risk factors identified in Table 1. As such, each factor was assigned a value from 1 thru 5, 1 being very low risk and 5 being very high risk. This risk analysis allowed us to identify which jurisdiction provided the least amount of risks based on the selected criteria. By establishing such a subsidiary, we will be able to circumvent withholding taxes on outgoing payments of dividends, interest and royalties. The routing of dividends through jurisdictions with favourable double tax treaties can help our organization avoid many such tax retentions. The key issues we looked at were: Zero to very low withholding taxes on dividends. No taxes in the jurisdiction of the holding company. Zero to very low withholding taxes on dividends (paid from holding company to shareholder). Although not a crucial immediate issue we should also consider whether our company would be subject to any tax on a future disposal of the subsidiary, or whether there would be any tax on a disposal of the holding company shares. It will also need to be considered whether Canada has any special provisions that apply to dividends from tax haven jurisdictions given our intent to locate to such countries. When identifying the most suitable location for opening a foreign-based subsidiary, we have found that the Isle of Man with its array of tax benefits, stable government, strong economy, and myriad of corporate and financial services will ultimately save our organization money, increase profits and streamline the operating costs of our business.
